1. Definitions
1.1 The following definitions are used in these Terms:
SUPPLIER: means the company delivering the heating oil or other product or service advertised on the website.
PARTICIPATING
SUPPLIERS: means the companies on the Sprint Fuels database whose prices
are compared in order to provide quotes for the price of heating oil
or other products.
MEMBER: means the user of the Sprint Fuels website either to obtain quotes or place orders for goods or services.
ORDER: means any order placed for products or services via the Sprint Fuels website.
HOME HEATING OIL: means domestic heating oil or Kerosene 28.
2. Sprint Website
2.1 The Web Site [www.sprintfuels.com]
is operated by Sprint Fuels Limited. Sprintfuels.com is a
service to users of home heating oil [and related products], providing
access to comparative prices for heating oil and related supplies and
services from its participating suppliers. Sprint Fuels
operates as an impartial price comparison website and quotes the
prices and services available from its participating suppliers in
accordance with information supplied by such suppliers to Sprint
Fuels.
2.2 These terms will apply to all transactions on this website, whether ordering online or not.
2.3
The services, information or data (collectively, "Information") made
available at the Sprint Fuels website are provided "as is",
without warranties of any kind.
2.4 By making any purchase from a
supplier featured on the Sprint Fuels website, you are
accepting that supplier's terms and conditions. Neither Sprint Fuels,
nor its management or employees accept any responsibility for any
liability resulting from any omissions or inaccuracies of any
information including price quotations presented by the companies
offering products or services featured on this website, or for any
complaints relating to those services, products or information.
2.5 Use of hyperlinks on the Sprint Fuels website is at members’ own risk.
2.6 Use of this website deems acceptance of these terms and conditions by the user.
3. Terms & Conditions for Members – [Heating Oil and other products/services]
3.1 Sprint Fuels is not an oil distribution company. Sprint
Fuels provides an online service enabling users (members) to
get a quote and place an order for heating oil [and related products
and services] with participating suppliers. Payments are enabled via
the Sprint Fuels website, we then instruct the supplier to supply the goods
and/or services and we settle payment with the supplier once they have
confirmed delivery of the goods and/or services.
3.2 Individuals
become a Sprint Fuels member by obtaining a quote, placing an order, or
registering their details on the Sprint Fuels website. Members can unsubscribe
from Sprint Fuels at any time.
3.3 Membership is free and Sprint Fuels will
not request financial or bank details from its members other than
during the ordering or the savings scheme process.
3.4 Upon
request, Sprint Fuels will provide members with the quote from suppliers
of the goods and/or services in their area who are registered with
Sprint Fuels. There is no obligation to accept the quote.
3.5 A member accepts a quote by completing the online order form and supplying credit or debit card payment details.
3.6
Once payment has been cleared through the secure banking system, the
order is passed to the supplier which will deliver the requested goods
and/or services at the price quoted (subject to 3.13) at the time
the order was placed, as shown on the order acknowledgement email.
This price will be confirmed in the order confirmation email and can
be viewed on the member’s “account” page of the website.
3.7
The appointed supplier will arrange delivery. Guidelines on estimated
length of time until delivery are provided with online quotations.
However, these are estimates and they can be subject to change, for
instance, in periods of high demand or unforeseen circumstances such as
accidents, breakdowns, extreme weather conditions, flood, storm, etc.
3.8
Sprint Fuels will not be deemed in breach of these terms and conditions as a
result of any delay in delivery which is caused by or due to
circumstances beyond our reasonable control ('force majeure event')
including, but not limited to, fire, flood and other acts of God,
extreme weather conditions, strikes, riot, accident, disruption to
energy supplies, civil commotion, acts of terrorism or war, breakdown of
equipment, road traffic problems and which are beyond the control of
the parties and upon the occurrence of a force majeure event which
prevents delivery any monies paid by the purchaser shall be repaid .
3.10
Sprint Fuels will protect the privacy of members and will not pass on
personal details to third parties other than the suppliers to the extent
an order is placed . Only delivery details will be passed to
suppliers once an order is confirmed.
3.11 Sprint Fuels has the right to refuse to process an order if payment cannot be made.
3.12 Sprint Fuels has the right to decline or cancel an order without prejudice and without liability.
3.13 The supplier has the right to decline or cancel an order without prejudice and without liability.
3.14
The responsibility for all aspects of performance, quality, safety
and accuracy of the delivery service rests with the Supplier and not
Sprint Fuels.
3.15 Deliveries are booked on the condition that there
is safe and reasonable access. Members are expected to provide
information about any special delivery conditions when the order is
placed.
3.16 Deliveries cannot be made to tanks/fill points that
do not meet the statutory requirements or are deemed unsafe by the
supplier at its absolute discretion.
3.17 Oil prices are
regularly updated by suppliers. If a supplier fails to update or
incorrectly updates prices and a member accepts a quote based on
out-of-date or incorrect information, they will be notified of the
anomaly by the supplier or by Sprint Fuels at the earliest possible
opportunity and be given the chance to accept or reject the new price
before the order is delivered. If the new price is rejected the order
will be cancelled.
3.18 A member can request that an order be
cancelled. However, Sprint Fuels reserves the right to charge an
administration fee for an order which is cancelled after it has been
passed to the supplier (i.e. after an order confirmation email has
been sent to the member). Cancellation of an order cannot be accepted
if the order has already been scheduled for delivery.
3.19 Save
as provided otherwise in this clause 3.19 [and clause 3.20], a credit
will be made to members where the volume of oil delivered was less
than that ordered. The money will be credited to the designated card
once the delivery has been confirmed by the supplier. Where a supplier
has not delivered the full volume ordered the supplier reserves the
right to refuse to deliver the balance and refund the difference.
3.20
Where it has not been possible to deliver the full order because the
ordered volume was significantly in excess of the tank’s capacity to
take the ordered volume, the supplier reserves the right to amend the
price per litre payable to reflect the appropriate price band for that
volume of oil.
